Disposal of surplus property – Land at
New Cottage Farm, J24, M25, The Ridgeway, Enfield

Decision

DECISION:
The Cabinet agreed to:
 

     
I.        
Agree, subject to obtaining the consent of the Secretary of State
and the Duchy of Lancaster, to the sale of Green Belt land to the
south of the M25 motorway, north of the Ridgeway and east of
Junction 24 of the M25, totalling 27.6 acres to the buyer referred
to in the Confidential Appendix.

Authorise the Director of Property
to finalise the Heads of Terms and to agree to any variations (save
for financial) to the Heads of Terms to facilitate the sale of the
land (a copy of the latest Heads of Terms being appended to the
confidential Part II report).
Note that the Leader of the Council
will receive and consider any representations made in response to
the statutory advertisement under section 123(2A) of the Local
Government Act 1972 for the proposed disposal of land before
deciding whether to continue with the disposal.
Authorise the Director of Property
to negotiate and enter into any agreement with any third party in
the event that any third-party rights affect the property.
Agree to the Council submitting
applications to both the Department of Levelling Up Housing and
Communities (DLUHC) and the Duchy of Lancaster for consent to the
sale of the land and the proposed end use.
Authorise the Director of Property,
in consultation with the Executive Director of Environment and
Communities, to agree any variation to the sale price within
acceptable valuation limits.
To note that all agreements to be
entered into as contemplated by this report are to be approved by
Legal Services on behalf of the Director of Law and
Governance.
