An update on the affordable Development and
Regeneration Strategy.

Decision

DECISION: The Cabinet agreed to:
 
 

     
I.        
Approve the Housing Delivery & Placemaking Ten
Year Plan 2026-36 found at Appendix 1.

   
II.        
Approve an ambitious but prudent Council House Building Programme
and bid set out in Part 2. To instruct officers to negotiate with
the GLA on the grant rates necessary to create a viable programme
in line with the parameters set out in this report and the report
on the HRA business plan elsewhere on this Cabinet agenda.

  
III.        
Bring forward a further report to Cabinet following negotiation
with the GLA to accept the funding and finalise the budgets
required for delivery.
 
In preparation for delivery,
and subject to agreement of III above:
 

 
IV.        
Delegate authority to the Executive Director for Housing and
Regeneration to negotiate with the GLA on future amendments to the
grant rates secured in the upcoming SAHP 26-36 funding bid, to
adapt to future changes in financial conditions, with any resultant
changes to be reported back to Cabinet as an update.

   
V.        
Delegate authority to the Executive Director for Housing and
Regeneration to reallocate the tenure mix of future housing
developments, as appropriate to changing financial conditions and
resident need, including intermediate and market tenures and Build
to Rent, with any material changes to be reported back to
Cabinet.

 
VI.        
Delegate authority to enter into the land and build contracts or
any other legal agreements associated with the delivery of
affordable homes up to the value set out in Part 2 to the Executive
Director of Housing and Regeneration subject to approval by the
Director of Law and Governance.

VII.        
Delegate authority to the Executive Director of Housing and
Regeneration to spend right to buy receipts and any other capital
receipts in accordance with the Ten Year Plan to acquire homes for
affordable housing to support the overall HRA Business Plan in
response to accelerating delivery over the next 10 years.

VIII.        
Delegate authority to the Cabinet Member for Housing to agree to
the principle of acquisition of land in the borough up to the value
of the amount delegated to the Executive Director of Housing and
Regeneration in accordance with legal advice, the Council’s
Constitution and statutory constraints for the purpose of
developing schemes to deliver affordable homes.

 
IX.        
Delegate authority to the Executive Director for Housing and
Regeneration in consultation with the Director of Law and
Governance to agree the ancillary agreements and documents related
to the purchase of homes or land as detailed in the previous
recommendations.

   
X.        
Delegate authority to the Executive Director for Housing and
Regeneration in consultation with the Director of Law and
Governance to enter into an Early Works License as set out in Part
2 where appropriate to investigate, de-risk or prepare sites for
delivery, in accordance with legal advice.
 

 
XI.        
Delegate authority to enter into Framework Joining
Agreement(s) with any of the specified London local authorities
within the Council’s own Affordable Housing Framework (refer
to Appendix 3 – Framework Joining Agreement of approved
KD5550) to the Executive Director for Housing and
Regeneration.

 XII.        
Delegate authority to the Executive Director for
Housing and Regeneration in consultation with the Director of Law
and Governance to agree the principle of entering into development
agreements with external organisations for the purpose of providing
affordable housing, subject to the necessary legal advice being
sought.

XIII.        
Delegate authority to the Executive Director for
Housing and Regeneration in consultation with the Chief Financial
Office to agree the principle of
entering into funding agreements with external organisations for
the purpose of providing affordable housing, subject to the
necessary legal advice being sought.

XIV.        
Delegate authority to the Executive Director for
Housing and Regeneration to procure professional advisors up to the
value set out in Part 2 to support the delivery programme in
accordance with budgets approved in the HRA Business
Plan.
