Purpose

To seek Cabinet approval to renew, by means of
a contract variation, the current Section 75 Framework Partnership
Agreement (under the National Health Service Act 2006) between
Gloucestershire County Council and Gloucestershire Integrated Care
Board which covers the combining of resources to deliver certain
health and social care services.

Cabinet approval to renew, by means of a contract variation, the
current Section 75 Framework Partnership Agreement (under the
National Health Service Act 2006) between Gloucestershire County
Council (“the Council”) and NHS Gloucestershire
Integrated Care Board (“the ICB”) which covers the
combining of resources to commission and deliver certain health and
social care services.
 
Having considered all of the
information, Cabinet noted the report and

RESOLVED to:
 
 

1.              
Approve the renewal, for a further period of 3
years, of the current Section 75 Framework Partnership Agreement
dated 25th March 2021 between the Council and the ICB relating to the
commissioning of health, public health, children’s and adult
social care services (in exercise of powers under Section 75 of the
National Health Service Act 2006) (the “Section 75
Agreement”) that was entered into between the Council and the
ICB pursuant to a Cabinet Decision on 11th March 2020 and
subsequently extended pursuant to a further Cabinet Decision on
25th January 2023.
 

2.              
Approve a variation to the Section 75 Agreement by
means of a deed of variation (the “Deed of Variation”)
that will give effect to the renewal described in Recommendation
1.
 

3.              
Delegate authority to the Director of Integrated
Commissioning – Adults, in consultation with the Deputy Chief
Executive / Executive Director of Corporate Resources to
incorporate into the Deed of Variation the financial arrangements
described in paragraph 12 of this Report relating to the
Council’s spend under the Section 75 Agreement during
financial year 2024/25 once these financial arrangements have been
signed and dated by the Directors of Finance for the Council and
the ICB.
