Purpose
Following a competitive process initially
intended to establish a Framework Agreement for the delivery of
residential and nursing care services, and in consultation with for
Cabinet Member for Adults’ Support and Independence, in
accordance with the Cabinet decision of 15 May 2024, the Council
has since revised its approach.
While the original intention was to use a Framework Agreement, we
have subsequently decided to proceed with a Master Services
Agreement (MSA) instead. This change is based on external legal
advice and reflects a more appropriate contractual model for the
nature of the services being commissioned. This adjustment ensures
contractual clarity and better alignment with the Council’s
commissioning intentions, without altering the substance of the
original decision.
DECISION
To award a Contract for the supply of residential and nursing care
services within five care homes in the Council’s estate to
Agincare Homes Holdings Ltd. The Contract will be for an initial
period of five years.
Subject to mutual agreement between the Council and the provider,
and further Cabinet approvals, the Contract may be extended for
additional periods of up to five years, provided that the final
expiry date does not exceed 31 January 2040.
