The Licensing Sub-Committee in considering this decision from the information presented to it within the report and at the hearing has determined that having regard to the promotion of all the licensing objectives:
• The prevention of crime and disorder;
• Public safety;
• Prevention of public nuisance; and
• The protection of children from harm,
The application for a premises licence has been approved in accordance with the Council’s Statement of Licensing and the proposed conditions set out in paragraph 8.1 of the report.

Reasons for the decisions.
The application for a premises licence has been approved, as members of the Licensing Sub-Committee were satisfied that the licensing objectives would not be undermined.
The Sub-Committee noted that the Environmental Enforcement Service withdrew their representations after agreeing conditions with the Applicant. The Sub-Committee noted there were no objections received from other Responsible Authorities .
The Sub-Committee took into consideration there were five Other Persons (local residents) who objected to the application. The Sub-Committee took into account the representations from local residents who felt core hours would be more acceptable however Sundays are still an issue.
The Sub-Committee heard representations from the Applicant that the premises opened on the 21st of March 2025, and has a collection area at the back of the premises. The Applicant confirmed that drivers pick up orders from the collection point. The Sub-Committee heard that the drivers come within five minutes of the food being ready 97% of the time. The Applicant confirmed that the premises worked with the Environmental Protection Service to overcome any noise issues. The Applicant made representations that they jet washed the area twice a week.
The Sub-Committee heard from the Applicant that they worked with the Environmental Enforcement Team to move the waste to a dedicated area. The Applicant contended that the rubbish and litter came from other takeaway businesses. It was noted that the bin collectors have fobs so that they can collect the waste without causing a disturbance.
The Sub-Committee took into consideration that the Applicant accepted that they needed to reduce the hours significantly from 03:00. The Sub-Committee noted that the Applicant did not want to upset their neighbours.
The Sub-Committee heard from the Applicant that the Dalston premises is a low volume store they have seven members of staff on a Saturday, and on weekdays four members of staff.
The Sub-Committee felt the reduced hours in line with Policy LP3 agreed by the Applicant were more reasonable. The Sub-Committee was satisfied that the waste issues were resolved such as the maintenance of the extractor fan and that the Applicant had worked with the Environmental Enforcement team to overcome any issues.
The Sub-Committee felt satisfied that workers do not go out to Ashwin Street, and that they have a separate staff room which will reduce any impact on local residents.
The Sub-Committee felt reassured that the drivers and members of the public will be allowed to use the toilets at the premises.
Having taken all of the above factors into consideration the Sub-Committee was satisfied that by granting this variation of the premises licence, the licensing objectives would not be undermined
