Application to Vary a Premises Licence – The Talbot, 109 Mortimer Road, London, N1 4JY - APPROVAL

The decision of 7th July 2026

The Licensing Sub-Committee, in considering this decision from the information presented to them within the report and at the hearing and having regard to the promotion of the licensing objectives:

? The prevention of crime and disorder

? Public safety

? Prevention of public nuisance

? The protection of children from harm

The application to vary a premises licence has been approved in accordance with the Council’s Statement of Licensing and the proposed conditions set out in paragraph 8.1 of the report.

?   Amended condition 13 to read as follows:

“Kitchen extraction fans in the backyard shall be switched off between 22.30 and 08.00 Sunday to Wednesday and 23.00 and 08.00 Thursday, Friday and Saturday”.

?   Partially granted the removal of the non-standard timings for Christmas  Day to read as follows: “Christmas Day: 12.00 to 23.30/00:00.”

?   Remove conditions 8 and 9 (relating to permitted hours under the Licensing Act 1964) from the premises licence.

?   Remove live and recorded music from the application.

And add the following conditions to the premises licence:

?   A written Dispersal Policy shall be submitted to the Licensing Authority and the Police and be maintained at the premises and implemented at all times the premises is open to the public. The Policy shall include measures to ensure customers leave the premises and the immediate vicinity quietly and with respect for local residents. A copy shall be made available to an authorised officer of the Licensing Authority or Police on request.

?   Staff shall actively monitor the area immediately outside the premises and take reasonable steps to prevent customers from causing noise nuisance, obstruction or disturbance to residents.

?   After 22:00, no customers shall be permitted to drink or take drinks outside the premises.

?   After 22:00, no more than 11 smokers are permitted to smoke outside of the premises at any one time. Smoking by customers shall be limited to a designated area identified by the premises licence holder, and staff shall take reasonable steps to ensure that customers using that area do so quietly and do not obstruct the highway.

?   Clear and prominent notices shall be displayed at all exits of the premises requesting customers to leave quietly and respect local residents.

?   A litter patrol shall be undertaken in the immediate vicinity of the premises at the close of business, and any litter outside the premises shall be removed.

?   The premises licence holder shall take reasonable steps to ensure that any broken glass in the immediate vicinity of the premises is cleared as soon as practicable and in any event before close of business.

?   The premises shall provide a dedicated contact email address and telephone number for local residents to raise concern upon request. Any complaint received shall be recorded in the incident/refusals log and made available to authorised officers on request.

?   An incident log shall be kept at the premises and made available to authorised officers on request. The log shall record complaints received, incidents of disorder, refusals of alcohol, ejections, and any visit by a responsible authority.

?   The Premises Licence Holder shall hold 4 liaison meetings and publish each year (at least every 3 months) with local residents to address any concerns or complaints about the premises.

?   Glass bottles will not be emptied into outside bins between the hours of 22:00 and 08:00 the following morning.

?   On Thursday to Saturdays each week from 21:00 to 01:30 at least 1 SIA registered door staff shall be employed at the premises until past the end of service. The Premises Licence Holder shall maintain a register of SIA.

?   After 22:00 all windows and doors of the premises shall be kept closed, except for access and egress and in the case of an emergency.

?   The outside seating areas shall not be used after 22:00. All tables and chairs in the outside area shall be rendered unusable after that time.

Reasons for the decision

The application to vary this premises licence has been approved, as members of the Licensing Sub-Committee were satisfied that the licensing objectives would not be undermined.

The Sub-Committee took into consideration the representations of the 47 local residents both written and the representations made at the hearing by a number of local residents objecting to the application because of extensive noise and disturbance late at night which has had an impact on them. It was noted that there was 1 local resident in support of the application.

The Sub-Committee took into consideration that the Environmental Protection Service was the only Responsible Authority to make a representation. The Sub-Committee noted that the Environmental Protection Service objected on the grounds of public nuisance due to the extraction system and operating hours they are still receiving complaints about. The Sub-Committee noted that the Environmental Protection Service had visited and its officers did not witness a nuisance.

The Sub-Committee took into account the representations made by local residents including the following points:

·  There have been historic complaints about the premises from 2025. was noted that a number of local residents had lived in the area for a number of years and say that every inch of goodwill has been used.

·  The local residents had no faith that the Premises Licence Holder would uphold the licensing objectives and did not support later hours. The last complaint was at 22:52 when there was no doorman, no security at the premises, the doors were left wide open and there was a lack of crowd management.

·  One of the local residents who lives next door to the premises shares first floor space with the premises contended that there was no notification from the premises about the sporting events being shown and how long they would last.

·  The local residents felt the measures taken by the premises to reduce the noise were not effective. The local residents made representations about experiencing noise late at night due to customers on the balcony and people leaving the premises late at night.

·  A local resident explained that the noise can be heard from far away and proposed conditions cannot control or prevent the noise.

·  The local residents contended that people congregated on the street corner for up to an hour after they left the premises causing a nuisance. The local residents did not feel safe in their own homes and cannot sleep until customers have left.

·  The local residents felt that the Premises Licence Holder had disregarded the complaints from local residents about the operation of the premises and could have taken measures a year ago.

·  A local resident who lived in the area for 10 years made representations that  there was a noticeable change in the operation of the premises. The premises  doors are open late at night affecting local residents. It is a quiet neighbourhood.

·  The current manager is unable to control the acoustics in the premises on 14 April the premises had an alarm sounding late at night which caused a disturbance.

·  The local residents felt that the additional conditions offered by the premises does not mitigate the additional hours. and they are not confident that the premises will operate responsibly.

The Sub-Committee heard representations from the Premises Licence. Holder’s legal representative, that they are willing to work with local residents to overcome the noise issues. They will offer targeted controls and proposed conditions which are clear and robust. They are no longer seeking authorisation for live and recorded music. The operation of the premises has not changed and they do have respect for the local residents in the area.

The Premises Licence Holder made a representation that there is a manager living above the pub so it would be unusual for an alarm to go off for an extended period and not be switched off. In relation to deliveries these can be restricted. The Premises Licence Holder felt the condition in relation to benches was being complied with.

The Sub-Committee having taken all representations into consideration noted that the Premises Licence Holder agreed to remove live or recorded music from their application.

The Sub-Committee felt the Premises Licence Holder needed to be mindful not to have customers congregating around the premises late at night to prevent local residents being disturbed.

Having taken all of the above factors into consideration the Sub-Committee was satisfied that by granting this variation of the premises licence, the licensing objectives would not be undermined.
