RESOLVED:

The decision

The Licensing Sub-Committee in considering this decision from the information presented to it within the report and at the hearing today has determined that having regard to the promotion of all the licensing objectives:

·  The prevention of crime and disorder;

·  Public safety;

·  Prevention of public nuisance;

·  The protection of children from harm;

The application for a premises licence has been approved in accordance with the Council’s Statement of Licensing and the proposed conditions set out in paragraph 8.1 of the report.

·  The hours of licensable activity were approved as set out in the report.

And the following additional conditions to be added to the licence:

·  Clear and prominent notices shall be displayed in advance of the event and where they can be seen and easily read by local residents making them aware of the events.

·  The Premises Licence Holder shall maintain a dedicated contact

telephone number and email address that must be available at all

times. These contact details shall be included on any website of the

premises and on display at the premises.

Reasons for the decision

The application for a premises licence has been approved as members of the Licensing Sub-Committee were satisfied that the licensing objectives would not be undermined. 

The Sub-Committee took into account representations from the Applicant who confirmed that up to 2000 persons will be at the event. It is for 18 and over and the Krankbrother events have been in operation since 2012.

The Sub-Committee heard the area is predominantly commercial and that the site boundary will have a perimeter fence. There will be staff employed to deal with welfare, a sound team and the site is kept clean by litter pickers.

The Sub-Committee took into account that there were no representations received from

Responsible Authorities.

The Sub-Committee noted no acoustic consultants have tested the noise at any of the local residents' properties. The Sub-Committee heard that the Applicant had a positive engagement with the Responsible Authorities.

The Sub-Committee heard that the Applicant did engage with local residents in Clifton Street. The premises licence is with Hackney Council. The road closures are dealt with by other local authorities like Islington. However the Sub-committee noted that the western boundary of the site is within Islington.

The Sub-Committee took into consideration the representations of local residents that there were fundamental issues, They experienced noise nuisance and cannot stay in their own homes during the events. It goes against the Council‘s Licensing Policy LP6 for outdoor events. The Policy was designed to protect local residents. The noise cannot be mitigated.

The Sub-Committee took into account that the local resident moved into the area in 2021, and they tried to address the issues with the Applicant. However, they were very difficult and not helpful. It was noted that notices will be put up before the event for up to a month. The Sub-Committee took into account that the local residents made representations that the Applicant has not resolved the noise issues.

The Sub-Committee heard representations made by the Applicant that the Krankbrother events have been operating since 2012. This is an application for one event once a year that ends at 22:00. The Applicant contended that they have three premises licences, and this would be the fourth licence for these events. The Sub-Committee heard that the Applicant uses sub-contractors such as security and local people to run the event; those contracted by the Applicant are national organisations.

The Sub-Committee noted that the local residents have not been persuaded by anything that the Applicant has said they still maintain that the application should be refused and not granted

The Sub-Committee felt that the above two conditions to notify residents of who they can contact and report issues to and notification of when the event was to take place in advance of the event were important and should be added to the licence

The Sub-Committee felt that there was no reason to reduce the hours of the event which ended at 22:00.

The Sub-Committee took into consideration that the event will add to the nighttime economy. The Sub-Committee felt that the Applicant was an experienced operator and that if any residents have any issues with the event they should report it to the Licensing Authority.

Having taken all of the above factors into consideration the Sub-Committee was satisfied that by granting the premises licence the licensing objectives would continue to be promoted.
