Content
RESOLVED that:
1)
approval be granted to proceed to RIBA Stages 4-7, as outlined at
Key Points I-J of the report, for the redevelopment of the former
care home, Murray House on Acre Road (“the Site”) for
the purposes of specialist self-contained housing as set out in the
Full Detailed Business Case attached at Annex 1 of the report (to
follow);
2)
approval be granted for the submission of the Council’s
planning application for the erection of the new specialist
self-contained housing on the Site at the end of RIBA Stage 3, and
associated supporting submissions;
3)
the proposed procurement strategy at paragraphs 14-20 of the report
be noted and approved;
4)
a capital budget of £15.75 million in the Housing Revenue
Account (HRA) for the required preconstruction services;
professional services; demolition/enabling works and Principal
Contractor works for RIBA Stages 4-7 be approved as per paragraphs
25-33 of the report;
5)
the demolition of the current buildings on the Site and authority
to issue Section 80 Demolition Notice (Building Act 1984) be
approved;
6)
authority be delegated to Executive Director Place, in consultation
with the Portfolio Holder for Finance, Assets and Governance, the
Portfolio Holder for Commissioning, Customer Contact and Equalities
and the Portfolio Holder for Housing, acting in the best interests
of the Council to authorise the appropriation of the Site from the
General Fund to the HRA as outlined at paragraphs 34-41 of the
report pursuant to section 19(1) of the Housing Act 1985 and/or s
122(1) of the Local Government Act 1972;
7)
authority be delegated to Executive Director Place, in consultation
with the Portfolio Holder for Finance, Assets and Governance; the
Portfolio Holder for Commissioning, Customer Contact and Equalities
and the Portfolio Holder for Housing, acting in the best interests
of the Council, prior to any appropriation of the Site to the HRA
as outlined at section 6 above to authorise if required the
appropriation of the Site for planning purposes pursuant to s 122
of the Local Government Act 1972 and to negotiate with and settle
any lawful claims including entering into any legal agreements with
any third parties pursuant to section 204 of the Housing and
Planning Act 2016; and
8)
authority be delegated to the Executive Director Place, in
consultation with [the Portfolio Holder for Finance, Assets and
Governance, the Portfolio Holder for Commissioning, Customer
Contact and Equalities and the Portfolio Holder for Housing to
authorise any actions, procedures or apply for any consents to
ensure that the Council has complied with its statutory obligations
as required to enable the proposals outlined at section 6 and 7
above to be lawfully carried out including but not limited to
advertising any appropriation of Public Open Space within the Site
pursuant to s 122 (2A) of the Local Government Act 1972.
