Purpose

Approval is sought for the County Council to
enter into an agreement for an obligation on the developer to pay a
sum of £600,000 to fund the adapted bus service (currently
service 66) from Clitheroe to Nelson.

When consulted by Pendle Borough Council on a planning application
for the erection of 500 dwellings with infrastructure, the County
Council responded requesting that the developer should be required
to contribute monies totalling £600,000 to support
sustainable transport improvements.

Pendle Borough Council's Planning Committee have resolved to
approve the application, subject to various conditions and subject
to a Section 106 Agreement to cover related matters.

Authority to take this decision has been delegated under the Scheme
of Delegation to Heads of Service.
That the Head of Legal Services is authorised to enter into an
agreement under Section 106 of the Town & Country Planning Act
1990 in connection with the proposed development, providing for
obligations on the owner or developer of the land to pay a sum of
