Purpose
The investigation was initially commenced
following a query / complaint from a local resident regarding some
carriageway resurfacing completed on a section of Four Acre Lane.
The question to be answered concerns the extent of our MAPE
vehicular carriageway in one section of Four Acre Lane, as
electronically digitised on our internal system.
When considering evidence, if it is shown that a highway existed
then highway rights continue to exist (“once a highway,
always a highway”) even if a route has since become disused
or obstructed, unless a legal order stopping up or diverting the
rights has been made.
Following the investigation it is recommended that our digitised
extent of publicly maintained highway is correct, as is our
digitised PROW extent and therefore no changes are required. This
concurs with statutory documentation and other documentation dating
back to the late 1920's.
