Purpose
Approval is sought for the County Council to
enter into a supplemental agreement under Section 106A of the Town
and Country Planning Act 1990, in relation to Wyre Council planning
application 17/00632/OUTMAJ which is an outline application for the
erection of up to 48 dwellings.
A Section 106 Agreement for the application has already been signed
dated 24th March 2022 with the Local Highway Authority securing the
following contributions:
• £76,800 payable towards Sustainable Transport
Measures.
The deed of variation is a linking agreement for the alteration to
the Green Infrastructure Contribution definition. This
doesn’t affect the already secured highway
contributions.
Authority to take this decision has been delegated under the Scheme
of Delegation to Heads of Service.
It is recommended that the Director of Law and Governance is
authorised to enter into a Section 106 agreement under Section 106
of the Town & Country Planning Act 1990 in connection with the
proposed development.
