Purpose
As part of the Department of Education's
Schools Rebuilding Programme, the Secretary of State has entered
into a construction contract with Conlon Construction Limited to
rebuild Seven Stars Primary School in Leyland. Under these
arrangements, as the county council is not a party to the contract,
it is a requirement that the building contractor, subcontractors
and consultants engaged in the project provide collateral
warranties in favour of the county council to provide the county
council with a right of action against the responsible parties in
the event of issues relating to the build. The collateral
warranties are in a standard form provided for under the
construction contract; and following consultation with legal
services, on 6 May 2025 the Director of Growth and Regeneration
authorised the execution of the collateral warranties on behalf of
the county council in accordance with his General Management Powers
under the county council's Scheme of Delegation to
Officers.
