DECISION NOTICE

1. Bottlecave Ltd (“the Applicant”) applied for a new Premises Licence on the 17th May 2026 for Bottlecave, Sydenham Road, London SE26 5QW (“the Premises”).
2. The application was made and advertised by owner of the business in accordance with Regulation 25 of the Licensing Act 2003 (Premises licences and club premises certificates) Regulations 2005. The last date for representations was 14th June 2026.
3. The particulars proposed for the premises licence were:

The application is for the following:

Supply of alcohol for sale by retail ON the premises

1. 00 - 21.30 Monday to Sunday

Supply of alcohol for sale by retail OFF the premises

1. 00 - 23.00 Monday to Sunday Opening hours of premises:
2. 00 - 23.00 Monday to Sunday
3. A representation was received from a local resident, objecting to the application on the grounds that it did not prevent public nuisance or promote public safety. The representations were received within the specified time, were examined by Officers and were not considered to be vexatious or frivolous. No representations were received by the Licensing Authority nor by any responsible authority.
4. The Applicant offered conditions as part of the application, appearing in Section M, on pages 26 to 27 of the Agenda and reports pack,
5. The Licensing Sub-Committee C held a meeting on the 8th July 2026 to consider the Application. Safer Communities, Licensing Officer, Kennedy Obazee, introduced the report. The owner of the applicant company, Mr Kamaran Shahzad, was then invited to address the Sub-Committee in support of the premises licence application. He was allowed a fixed period of time and answered Members’ questions. Mimi Jason, who had submitted written representations appeared at the meeting to speak to the Sub-Committee. She was allowed the same fixed period of time, and she also answered Members’ questions At the end, the Applicant was given an opportunity to briefly sum up his case and so was the objector.
6. In making its decision the Sub-Committee has considered all the papers contained in the report pack and submitted documents, including written submissions, together with the oral submissions of the Applicant and the objector. The Sub-Committee also considered the Council’s own Statement of Licensing Policy 2026-31 and the latest Home Office Statutory Guidance, revised in February 2026.
7. The decision of the Sub-Committee is to grant the premises licence as applied for, that is:

•         Supply of alcohol for sale by retail of ON the premises, between the hours of

1. 00 to 21.30 Monday to Saturday.
2. 00 to 21.00 Sunday

•         Supply of alcohol for sale by retail of OFF the premises, between the hours of

1. 00 to 23.00 Monday to Saturday.
2. 00 to 22.00 Sunday.

And in accordance with the conditions appearing in section M of the application and the following further conditions:

No waste or recyclable materials, including bottles, shall be moved, removed from, or placed in outside areas between 23:00 hours and 08:00 hours on the following day.

•         The customers will be prohibited from using the rear garden area for drinking, smoking or standing. The rear access will only be used by customers to exit in the event of an emergency.

1. The Sub-Committee’s reasons for taking this decision are:

a.     The reduced hours for both on and off alcohol sales on a Sunday are appropriate and necessary to prevent the potential of nuisance to neighbouring residents.

b.     The two additional conditions are necessary, appropriate and proportionate in this case to promote the licensing objectives in the operation of the Premises.

c.      The Sub-Committee reminds the Parties that on the Premises becoming operational, if concerns arise over complying with the licensing objectives it is open to any person to instigate the licence review process.

1. There is a right of appeal against this decision. Any appeal should be made to the Magistrates’ court within 21 days beginning with the day on which the Applicant was notified of the decision.

Any person who has given notice of appeal on a licensing decision to the Magistrates Court, or is considering doing so, should not approach council officers for legal advice. A person making an appeal should seek independent legal advice, for instance, from a firm of solicitors or the local Citizens Advice Bureau may be able to assist.
