Full council record
Purpose
Approval is sought for the
allocation of £193,500 of financial contributions in the
Section 106 Agreement ‘Land at Fradley Park, Halifax
Avenue’ towards improvements to play areas within Fradley
Parish.
Decision
To allocate £193,500 of the
‘Social and Community Sum’ financial contributions in
the Section 106 Agreement for ‘Land at Fradley Park, Halifax
Avenue’, planning application 10/01498/OUT, towards the
following project within Fradley Parish: Play area improvements
within Fradley village.
Reasons for the decision
The Section 106 Agreement for ‘Land at
Fradley Park, Halifax Avenue’ (planning application
10/01498/OUT), signed on 24th October 2013, secured financial
contributions collectively known as the ‘Social and Community
Sum’. The value of these contributions is £193,500. In
terms of the contributions’ legal purpose, the Agreement
states the following:‘…to
be used by the District Council for the provision or maintenance of
health facilities public art and social facilities (to include
changing facilities linked to off-site pitch provision).’
The Parish Council are working with Lichfield
West Midlands Trading Services (LWMTS) to deliver improvements to
two play areas within Fradley village and the total budget for the
project is £277,803. The project
satisfies the Social and Community Sum’s legal purpose by
improving and maintaining social facilities within Fradley
parish, therefore it is recommended that
the £193,500 contribution is allocated towards this
project.
Alternative options considered
The alternative options were considered:
Option?
Consideration?
Selected
option?
Not to allocate the Section
106 financial contribution towards the play area improvements
within Fradley and instead allocate
towards an alternative project.
This option is not recommended as the project meets
the S106 requirements and the financial contributions are required
to be allocated by a specific date (in this case February 2026)
otherwise it risks being claimed back by the developer. The Council
should also be proactive in allocating S106 contributions towards
projects which satisfy the specific requirements as set out within
the Agreement.
Allocate the S106
contribution towards the play area improvements
