The decision of the Committee is to grant the
application subject to the agreed conditions

State
 
Committee’s reasoning and findings
are:
 
Committee noted that the application before it
was for an Indian restaurant.  The sole
director of the Applicant company has previously held the position
of general manager for a restaurant on the quayside in Newcastle
and has been responsible for off licences and general dealers. He
is an experienced operator.
 
Ms Smith explained that she has agreed
conditions with Northumbria Police and the Licensing Authority to
resolve any issues that they may had had.  There are no other representations from
Responsible Authorities.  She had
attempted to enter into a dialogue with local residents to mediate
and resolve their concerns but received no response.  She confirmed that there would be no change to the
operating style of the premises.  Ms
Smith apologised for any confusion regarding the playing of live
music and confirmed that the premises would only have ambient
background music.  The google profile
which had initially been set up has been amended to reflect the
correct position.
 
Members had regard to and attributed
appropriate weight to the written representation of the local
resident but noted the absence of representations from the
Responsible Authorities and the fact that the premises have been
operating since August without complaint or issue.  Patrons had been bringing their own alcohol during
that time.
 
In the circumstances, Committee unanimously
felt that to grant the application subject to the agreed robust
conditions would not undermine the licensing objectives.
