Decision

To approve a Wayleave over Newdown Road
Bottesford to Northern Power Grid (Yorkshire) plc, in accordance
with section 6.6 of the council's approved scheme of delegations to
officers and appointment of proper officers.

Reasons for the decision

The installation of underground apparatus will
not affect the existing or future use of the land. However, the
footpath and grassed verge must be reinstated to an adoptable
standard and the satisfaction of the council at the end of the
proposed works to ensure it is safe for public use and to avoid any
insurance claims. Approval of the Wayleave will allow Northern
Powergrid to meet the needs of its customer and fulfil its legal
obligations.

Alternative options considered

Not awarding the Wayleave would lead to
Northern Powergrid applying to the court for an order to access the
council's land and install its apparatus.
