City Council - Record of Decision
 
I,
Councillor Mike McCusker, Lead Member for Planning, Transport and
Sustainable Development in exercise of the powers contained within
the Council Constitution, do hereby:
 

Authorise the implementation of the Traffic
Regulation Order below, in the modified form, as set out in the
report.
 

City Of Salford (Ash Drive,
Swinton)

(Prohibition of Waiting,
Loading/Unloading) Order 2025
 
The
Reasons are: That the necessary action be
taken under the Road Traffic Regulation Act 1984 to advertise the
intention to make the Traffic Order to introduce City Of Salford
(Ash Drive, Swinton) (Prohibition of Waiting, Loading/Unloading)
Order 2024. The proposals will promote a safer environment for all
highway users. The prohibition of loading/unloading during school
peak times combined with no waiting at any time restrictions will
prohibit any vehicles from carrying out loading/unloading of goods
keeping the area clear by reducing the overall traffic.
 
Options considered and rejected were: All day loading ban was considered but it was not taken forward
as it will be  inconvenient for the
residents; whilst the issues are limited to school peak
times.
The
other option considered was the installation of physical bollards
on the footway, but it would reduce the effective width of the
footway. The footway is used regularly by the schoolchildren,
residents, and the community centre users.
 
Assessment of Risk: The scheme has
been designed in accordance with the Traffic Signs Manual and
Traffic Sign Regulations and General Directions 2016. The scheme
will contribute to improving the safety of all highway
users. 
 
The source of funding: The scheme is
funded by Swinton & Pendlebury Highways Devolved Budget
2024-2025
 
Legal Advice obtained: The Council, by
virtue of the Road Traffic Regulation Act 1984 can introduce orders
to manage traffic. Where Traffic Regulation Orders are required,
they should not give rise to any particular legal implications,
provided the works and procedures are carried out in accordance
with the relevant statutory requirements, which would include the
consideration of any objections to a proposed Traffic Regulation
Order.
