The Reasons are:

External funding of £349,500 has been secured from Access Sport for the construction of a Community Bike Track at Cadishead Park. In addition, a budget of up to £77,250 of Section 106 contributions from S106 Ref: 470 - 22/81019/FUL has been made available.

Tenders have been invited for the works with the most economically advantageous tender (MEAT)  submitted by Architrail Velosolutions UK Ltd. The evaluation panel agreed it was an excellent proposal that met the required standard in all material respects and exceeded some of the major requirements. Examples of previous projects included development of pump tracks within other public parks and clearly demonstrated the technical ability required to meet the British Cycling and Sport England specification.

ArchitrailVelosolutions submission confirmed the use of a Salford based supply chain including plant hire, site security, supply of materials (aggregate, tarmac, concrete) and the use of Salford based sub-contractors (tarmac).

The provision of cycling safety equipment has also been pledged and confirmation received that all employees are paid above the Salford Living Wage. In addition, the donation and installation of a defibrillator located to the side of the pump track for public use is welcome.

On completion of this project the Cadishead Park Community Bike Track will enhance the local environment and provide a greatly improved community facility.

Options considered and rejected were:

None. Procedures are in accordance with normal contractual standing orders.

Assessment of Risk:

Medium. A delay in awarding the contract risks increased costs and may lead to difficulties regarding the availability of specialised, construction staff.

The source of funding is:

Legal Advice obtained:

When commissioning contracts for the procurement of goods, services or the execution of works, the Council must comply with the provisions of the Public Contracts Regulations 2015 as well as its own Contractual Standing Orders (CSO’s), Financial Regulations and the duties of Best and Social Value. In addition, the PCR require that contracting authorities treat candidates equally and in a non-discriminatory way and act in a transparent manner, failing which the award of a contract may be subject to legal challenge.

The procurement procedure undertaken in this matter including publication on the Chest portal as an open procedure appears robust and compliant with the requirements of CSO’s and PCR. The appointment of the provider for the Cadishead Park Community Bike Track follows the open tender process, which is outlined within the body of the report, with bidders being evaluated on the most economically advantageous tender, resulting in the proposed award of the contract to Architrail Velosolutions UK Ltd.

Having undertaken the open tender exercise process set out in the report, the Council may take comfort that value for money has been obtained and periodically tested, with open competition maintained.

Financial Advice obtained:

The costs of this project will be met from:

·      Access sport - £349,500

·      S106 contribution (ref 470) - £22,668.21

There is little financial risk to Salford City Council with this project as there is an additional £54,581.79 of S106 money available to meet extra costs should it be required.

The procurement process taken was an open procedure and was advertised on the Find a Tender Register. The procurement process is inline with constitution of the council and the public contract regulations 2015.
