Salford City Council - Record of Decision

I Councillor Tracy Kelly, Deputy City Mayor, in exercise of the powers contained within the City Council Constitution do hereby approve the proposed expenditure of £2,021,877.38 of Section 106 contributions towards delivery of public realm and open space improvements within the Greengate Regeneration Strategy area.

The Reasons are to meet the requirement of the relevant Section 106 Agreements detailed within the report. The project will deliver public realm and open space projects at the northern edge of the Greengate neighbourhood and, if feasible, the relocation of the existing War Memorial located at the junction of Trinity Way and Blackfriars Road with associated open space improvements. This area has been the focus of significant development over recent years, with a number of schemes delivered, on-site and consented. Investment in high quality new public realm in this area will improve visibility of and permeability into the neighbourhood from communities to the north and ensure that the area is properly connected to the surrounding green and blue infrastructure and walking/cycling connections along the River Irwell and Trinity Way.

Options considered and rejected were: none

Assessment of Risk: Low - Developers can seek to legally challenge the city council to claim back Section 106 monies if not used on a scheme that mitigates the impacts of that development and/or spent in line with the requirements of the Section 106 agreement.

The source of funding is:

Section 106 Contributions received from the developments at:

§  £1,259,780.16 from Greengate 1 (Section 106 Ref: 281 - 13/63524/FUL); and

§  £762,097.22 from City Suites 1 and 2 (Section 106 Ref: 284 - 14/65048/FUL).
