The reasons are:
To allow the continuation of the All-Age Carers Service, supporting unwaged carers across Salford, and the Bereavement and Complex Care Counselling service, for a further 12 months.
The contract extension will allow sufficient time to finalise and implement the refreshed All-Age Carers Strategy and the preparation associated with the All-Age Carers Service retender.
It will also allow sufficient time to explore a Greater Manchester approach with other localities who provide a counselling service through Gaddum within the Integrated Care Board to align the Bereavement and Complex Care Counselling contract.
Options considered and rejected were:To reject the 12 month extension request.
Assessment of risk: If the exception is not approved and the current contract is not extended then the impact may be a reduction in service quality to a vulnerable group of people who live in Salford.
The source of funding is: Pooled Budget arrangements.

This report sets out extensions to two existing contracts with the Gaddum Centre.
The Salford Carers Service was procured under the previous Public Contract Regulations 2015 regime (PCR) and therefore any contract extension will remain subject to this regime (together with the Council’s own contractual standing orders- CSR). The original contract term was for 5 years and the contract provided for an optional extension of one year as set out in the report above. Therefore the proposed contract extension has already been accommodated the core Salford Carers Service within the existing contract terms and can be extended under PCR regulation 72(1).
The Salford Children and Young People Bereavement and Complex Care Counselling service was varied into the Salford Carers contract. This variation was time limited and did not provide for an option to extend these services, therefore any further variation is subject to the provisions of regulation 72 of PCR 2015. This allows for contract modifications without competition in certain permitted circumstances. The most relevant provision would be either regulation 72(c), which provisions that the need for extension has been brought about by circumstances a diligent authority could not have foreseen, it does not alter the overall nature of the contract and the increase in price does exceed 50% of the value of the original contract (the original contract value being the value of the Salford Carers contract prior to the Children and Young People Bereavement and Complex Counselling Services). The value of any previous variations for the bereavement service and any additional variations for any other services added with the proposed 15 month extension to determine the modification value.
Under the CSRs, procurement board can approve any contract modification value. CSR paragraph 9.14.7 states “Where there is no provision to extend within the original contract, all approvals for extensions, shall be referred to the Lead Member and Procurement Board. In any such instance officers should treat the matter as an exception.”. In terms of being an exception to CSOs, these are described in paragraph 9.13.1. The report positively describes Gaddum’s delivery of the services, suggesting that it is delivering best value and the services relate to “Special education, health or social care contracts, if, it is considered in the Council’s interests and to meet its obligations under relevant legislation”.
The proposed contract variation should be documented in a deed of variation setting out the updated contract value (and any agreed adjustments to the specification or KPIs, if any). SLS can assist with drafting, finalisation and execution.

The funding for the 12 month extension to the Salford Carers Service will be available through the Integrated Fund.
The amount of £490k includes a percentage uplift on the previous years funding (£471k) which is subject to approval through the Integrated Fund governance.

The Corporate Procurement Team concurs with the legal comments outlined above with regards to the contract extensions. The extensions will allow the services, which are performing well, to continue for the allowable extension period. Corporate Procurement will advise and support on any re-procurement activity during the extension period, in line with the new Procurement Act 2023.
