I, Councillor Mike McCusker, Lead Member for Planning, Transport and Sustainable
Development, in exercise of the powers contained within the Council
Constitution, do hereby
approve:
 
The
expenditure of £289,000 of Section 106 contributions towards
Bolton Road Pitch Improvements and Barr Hill Changing Room
project.
 
The reasons are: to meet the
requirement of the relevant Section 106 Agreement detailed within
the report.
 
Options considered and
rejected:  Not applicable as the Section 106
Agreement detailed within the report requires expenditure on
specific individual projects or types of projects.
 
Assessment of
risk: Low – The delivery of these
sports facilities improvements will satisfy the terms of the
Section 106 agreement.
 
The source of funding
is: Section 106 contributions of £289,000 which have been
received from the developments located at:

Section 106 contributions can
only be expended in accordance with the terms of the planning
obligations outlined in the relevant Agreement.   If the Council cannot demonstrate that the
contribution has been expended in accordance with the Agreement,
there is a risk that the contribution may need to be repaid to the
developers.  The accompanying report
explains why officers are of the view that the expenditure set out
herein would be in line with the terms of the Agreement

The £289,000 Section 106
funding as identified in the report is towards Bolton road changing
rooms. The funding will be used towards improvements to the
clubhouse facilities serving the Bolton Road grass
pitches.
The funding as identified in
the report has been received and are available to fund the
works.

Climate change implications are
considered through the planning application process, and where
relevant appropriate mitigation will be identified through planning
conditions and/or planning obligations. The Section 106
contribution can only be used towards specific mitigation in
accordance with the respective Section 106 agreement. This project
is for Bolton Road pitch improvements and Barr Hill Junior Football
Club Changing Rooms project.
