for Finance and Support Services and chairman of the Procurement
Board, accept the recommendation of the Procurement Board and in
exercise of the powers contained within the Council Constitution do
hereby approve:
 
·     
an exception to Contractual Standing Orders as
permitted within the City Council Constitution and award the
Contract for asbestos removal and additional demolition works at

The reasons are: to enable
the works to progress to the agreed programme and prepare the site

Options considered and rejected were: None – All procedures are in accordance with
normal standing orders.
 
Assessment of risk:
High – Failure to undertake the works exposes the council to
risk of unauthorised entry to a dangerous site and exposure to
asbestos containing materials.
 
The source of funding is:
Brownfield Land Release Fund.

The Public Contracts
Regulations (PCR) allows, through regulation 72, a number of
“safe harbours” when contracting authorities need to
modify existing contracts in a way which does not require a fresh
procurement, as well as considering whether the modification is
substantial at all. Regulation 72 (1) (b) provides for additional
works, services or supplies where a change of contractor would
cause significant inconvenience (as defined in regulation 72 (8))
will be permitted, as here.

Cost Code: P00109
– The Procurement Board report seeks approval for the
additional costs to the demolition of the former St Ambrose Barlow
High School to Connell Brothers. The original tender process was
completed by mini competition under the Demolition and Associated
Works Framework Lot 1.
 
The total cost of the
additional works requested in this report is £0.181m. The
full contract value is £0.824m which consists of construction
costs to Connell Bros of £0.572m plus surveys, professional
fees, clearance and associated costs of £0.252m.
The scheme is recognised in the Place, Property Capital
programme for 2025/26 and will be funded from Brownfield land
Release Grant of  £1.499M and
Unsupported Borrowing of £0.195M, making a total of
£1.694M funding available in 2025/26.

The contract was
procured by utilising the Salford City Council Demolition and
Associated framework Lot 1. Due to the increase in cost for
additional work Regulation 72 permits there to be changes or
modification as long as this does not exceed 50% of the contract
value, which in this case does not apply. Therefore, this is
complaint with Procurement Contract Regulations and the Councils
own Contractual Standing Orders.

Climate change implications obtained: Building Surveying &
Facilities Management Team
No significant Climate Change
implications in this project. All projects are developed to meet or
exceed current legislation and requirements to energy efficiency
and carbon reduction targets. Projects are required to support the
Council’s objectives of becoming carbon neutral by
2038.
 
The works will be programmed to
minimise the traffic impact in the area. Any waste materials will
be removed and taken to a transfer station for systematic sorting
and recycling to ensure minimal landfill waste.
 
Sustainability plans would be
targeted to also align with opportunities to continue to deliver
social value outcomes.
