The Reasons are: to undertake the development design
study for the proposed Pendleton Wellbeing Hub to replace Clarendon
Leisure Centre.

When commissioning
contracts for the procurement of goods, services, or the execution
of works, the Council must comply with the Public Contracts
Regulations 2015 (PCR 2015) if applicable, the Procurement Act 2023
and its own Contractual Standing Orders (CSO’s), failing
which a contract may be subject to legal challenge from an
aggrieved provider.  CSO’s
stipulate that where a suitable framework agreement exists, this
must be used unless there is an auditable reason not to do
so.
 
The Council have made
use of the UK Leisure Framework as the preferred route to market
for consultancy and professional services which is compliant with
public procurement legislation.
 
The purpose of a
framework agreement is to select, through a procurement/evaluation
process, a provider who can meet the service requirements of the
Council, as and when those services are required. If they are
required, the Council will undertake an exercise to call off the
services from one or more of the providers who have been selected
to be on the framework and this may be through a number of ways
including mini/further competition or by direct award depending on
the circumstances. A contract will then be formed between the
Council and the chosen provider/s.
 
The Council will need
to have followed the procedure set out in the framework agreement
for direct award to ensure that the process is compliant. As there
is only one provider on the UK Leisure Framework, a single bid has
been received and evaluated in line with the published procedures
resulting in the proposed award of the contract to Alliance
Leisure. The procurement procedures therefore appear robust and
compliant with the requirements of the Council’s CSO’s
and the PCR 2015 which is applicable in this case.

The report is seeking
approval of contract to Alliance Leisure Limited to provide
consultancy fees for development from RIBA 2
up to RIBA 3, spatial Coordination, for the Pendleton Wellbeing
Hub. RIBA stage 3 takes the concept designs of stages 1-2 and
ensures that all components of the building will work as intended,
this includes co-ordination of architectural and engineering
services. This work will inform the business case and also is a
necessary part of the process for bidding for Sport England
funding.

The total cost of the contract will come to £273,000. The
funding for this contract will be met by unsupported borrowing
within the approved Place capital programme. Expenditure code:
E05739.

with SCC Governance and public contract regulations 2015. Alliance
Leisure are the sole provider on the framework and they will act as
a delivery partner to find suitable providers to deliver the
various elements of the contract.

Climate Change Implications obtained: Building Surveying and
Facilities Management
No significant Climate Change
implications in this project. All projects are developed to meet or
exceed current legislation and requirements relating to energy
efficiency and carbon reduction targets. Projects are required to
support the Council’s objectives of becoming carbon neutral
by 2028.
 
Sustainability plans would be
targeted to also align with opportunities to deliver social value
outcomes.
