Salford City Council - Record of Decision
I Councillor Jack Youd, Deputy City Mayor and Lead
Member for Finance, Support Services and Regeneration, in exercise of the powers contained
within the City Council Constitution do hereby:
1.
Approve, in principle,
the introduction of the parking restriction measures on a number of
streets in Eccles and Claremont, and in close proximity to Salford Royal NHS
Foundation Trust; and
2. Authorise Officers to start
Traffic Regulation Order procedure, which includes statutory
advertisement of proposals in due course.
The Reasons are:
Following the expansion of Salford Royal
Hospital (Acute Receiving Centre – ARC, with Helipad),
Salford City Council entered into S106 agreement. One of items of
this agreement is to expand the existing Hospital Permit Parking
scheme operating in the area.
Options considered and rejected were: take no action and continue with
existing scheme
Assessment of Risk:
Low: The proposed restrictions will be marked
in accordance with the Traffic Signs Manual and Traffic Sign
Regulations and General Directions (TSRGD - 2016).
The source of funding is:
The cost of the proposed scheme will be met
from the approved Hospital’s S106 money allocated to the
permit scheme expansion.
Legal Advice obtained:
Traffic regulation is governed by the Road
Traffic Regulation Act 1984 (RTRA) and The Local Authorities
Traffic orders (Procedure) (England and Wales) Regulations 1996
(Regulations). Provided the introduction of any Traffic Regulation
Orders follow the procedure set out in the Regulations and are for
the reasons set out in the RTRA and the Council is acting
reasonable in the exercise of its power (and accordance with the
S.106 Town and Country Planning Act agreement) then the risk of any
legal challenge to the Council for failing to follow the prescribed
procedures will be minimal either in the High Court or through
Traffic Penalty Tribunal claims.
Schedule 4(1) to the s106 agreement states
that the Council covenants "To use the respective Contributions
received to the respective projects identified in this Agreement
only and for no other purpose".
The Interim Residents' only Parking Scheme is
identified in the Agreed Terms, Definitions, and Interpretation as
an "interim scheme to restrict on street parking to Residents only
within the area as identified on the plan [attached in Schedule 5
to the Agreement]".
The proposed expansion of the current scheme,
as outlined in the Property and Regeneration Briefing report,
extends to areas which were identified in Zones B, D, and F of the
Residents' Parking Schemes plan in Schedule 5 to the s106
agreement, and thus this proposal does fall within projects
identified in the s106 agreement (the Interim Residents' only
Parking Scheme) and within the area identified on the plan in the
s106 agreement. Therefore, the Interim Residents' only Parking
Scheme Contribution received under the s106 agreement can be used
for this purpose.
Financial Advice obtained:
The cost of statutory advertising is
approximately £10K, whilst the online facility is already
operational. Funding for this proposed scheme will be met from the
approved Hospital’s S106 monies allocated to the permit
scheme expansion (reference 19/73701/FUL).The council will receive
income from Salford Royal Hospital in respect of the permits once
active, whilst retaining responsibility for signage
maintenance.
