I, Councillor Mike McCusker,
Lead Member for Planning, Transport and Sustainable Development,
in exercise of the powers contained within the City
Council constitution, do
hereby:
I.
Note that a draft Supplementary Planning Document
relating to Planning Obligations, and associated supporting
documents, have been prepared; and
Approve a period of
public consultation on the draft Planning Obligations Supplementary
Planning Document, and associated supporting documents, lasting for
a period of 6 weeks (starting no earlier than Thursday 19 February
2026).
The
Reasons areSection 106 agreements, also known as planning
obligations, are legal agreements made between local authorities
and developers as part of the planning process. They are used to
limit the impacts of new development and to make development
acceptable in planning terms. The SPD has been updated to
supplement policies in the Salford: Local Plan: Development
Management Policies and Designations (SLP:DMP) and will be a
material consideration in the determination of planning
applications. The Government has set a deadline for
new SPDs to be adopted no later than 30 June
2026 under existing regulations.
Assessment of Risk
is low.
Consulting on the draft SPD
will give consultees the opportunity to comment on the draft before
the city council adopts a new SPD to meet the Government deadline
of 30 June 2026.
The
source of funding for the consultation
and associated printing and postage
will be met from existing
revenue budgets.

Before adopting a Supplementary
Planning Document, a Local Planning Authority is required to
undertake a public consultation for a period of at least four weeks
(The Council’s Statement of Community Involvement extends
this to six weeks). As part of the consultation, the Draft SPD must
be made available along with a statement setting out who has been
consulted during the preparation of the document, the main issues
raised by them and how those have been addressed in the Draft
SPD.
This report seeks approval to
carry out a consultation in accordance with the statutory
provisions and the Council’s SCI. The Council is also
required, during the preparation of a plan such as a SPD to
consider whether an Environmental Assessment or a Habitats
Regulations Assessment is required. The
report sets out the position in relation to these.

The Lead Member report is
seeking approval for a period of public consultation on the draft
Planning Obligations Supplementary Planning Document (SPD), and
associated supporting documents.
Within the SPD under section
2.6, the document states development contribution towards the full
range of planning obligations. The table below summaries the scale
of contributions for 2026/2027 prices.All
identified costs will be increased annually in line with inflation
by applying the Retail Prices Index (RPI), which will be published
annually by the City Council. Section 13.6 to 13.23 explains about
the implementation process of receiving payment, non-payment
process and costs which will be met by the developer.
