I, Councillor Youd, Lead Member
for Finance and Support Services and chairman of the Procurement
Board, in exercise of the powers contained within the
Council Constitution
do hereby approve:
1.
The appointment of A E Yates Limited, subject to TfGM’s
Active Travel Programme Board approval of the Delivery Plan for the
delivery of the scheme.
2.
The creation of a purchase order to A E Yates
Limited, to the value of £509,501.92, which will enable
payments to be made to the contractor.
3.
The utilisation of the £101,900 risk allowance
budget towards associated project delivery spends.
4.
For the contractor, A E Yates Limited to carry out
additional carriageway resurfacing work within the proximity of the
scheme at a quantified sum of £95,000.

The Reasons are: The existing junction facilities at
Bury New Road/ Moor Lane/ Singleton Road does not have traffic
signal-controlled crossing points on all arms and is problematic
for pedestrians and cyclists that are trying to cross at pedestrian
crossings. The proposed improvement works at the junction will
ensure better provision for active travel and supports safer
movements.
Options considered and rejected
were: None.
Assessment of Risk: There is risk of funding
withdrawal of the Active Travel Fund Tranche 2 funding award if
Salford City Council fails to commit and deliver the project within
2024/25 financial year.
Three sources of funds
are available for the development and delivery of this project, and
these include:

Active Travel England funding through the Active
Travel Fund (ATF) Tranche 2 programme.
·
Capability and Ambition Fund 2022/23 (extension
2024).
·
24/25 CRSTS Highways Core Maintenance
Programme.

When commissioning contracts
for the procurement of goods, services, or the execution of works,
the Council must comply with the Public Contracts Regulations 2015
(PCR) and its own Contractual Standing Orders (CSO’s),
failing which a contract may be subject to legal challenge from an
aggrieved provider. CSO’s state that a framework arrangement
should be used unless there is an auditable reason not to do so.
The proposed tender of the contract was be undertaken in accordance
with the STaR Highways Services Framework following Procurement
Board approval to go out to mini competition in January 2024, and
the Council will need to have followed the procedure set out in the
Framework Agreement to ensure the award is compliant.
The
award will be subject to TfGM’s Active Travel Programme Board
approval of the Delivery Plan for the delivery of the
scheme.

The report is requesting that a
contract be awarded to AE Yates in relation to the Bury New
Road/Moor Lane/ Singleton Road Junction programme following a
successful tender under STAR Highways Services framework. AE Yates
target cost for the scheme is £0.510m with a 20% risk
allowance of £0.102m for associated project delivery
spend.
The project is
recognised in the infrastructure capital programme. Funding is
provided through the Active Travel Fund Tranche 2 (ATF2). The
Greater Manchester Capability and Ambition fund Extension 2022/23
(extension 2024) and 2024/25 CRSTS Highways Core Maintenance
Programme. The report identifies a potential risk in withdrawal of
funding in respect of ATF2 if Salford City Council fails to commit
and deliver the project within 2024/25 financial year.

This project was procured as a
further competition under the STAR Highways Services Framework
– Lot 7 Civils which only resulted in one contractor bidding
for the work. Social Value resulted in a total of £85,204.
The framework complies with SCC standing orders and PCR’s
2015.

This project is an appropriate
use of funding on the basis that it provides crossings and
infrastructure to enable safer movements, especially for people on
foot or cycling at the junction of Bury New Road / Moor Lane /
Singleton Road. As noted, the existing junction does not have
traffic signal-controlled crossing points on all arms and is
problematic for pedestrians and cyclists that are trying to cross
at pedestrian crossings.
It is therefore envisaged that
the improvement works at this junction with the installation of
signal-controlled pedestrian crossing with push button facilities
across all arms of the junction and introduction of an ‘all
red’ stage for pedestrians will increase the number of people
walking and support modal shift from private motor vehicle, reduce
car dependency for short trips and improve air quality around the
area.
