City Council - Record of Decision
I,
Councillor Mike McCusker, Lead Member for Planning, Transport and
Sustainable Development in exercise of the powers contained within
the City Council constitution do hereby:
Instruct
Council Officers to process a revocation order to permanently
remove the suspended Bus Lanes on Gilda Brook Road and A576 Eccles
Old Road between Wellington Road and Weaste Lane.
The Reasons are: That the necessary
action be taken under the Road Traffic Regulation Act 1984 to
advertise the intention to revoke ‘The City of Salford (A576
Eccles Old Road, Salford) (Reserved Bus Lane) Order 1998’ on
a permanent basis. This revocation order would provide road safety
benefits by formalising a new road marking layout, removal of
redundant signage and promote the expeditious movement of traffic
flow by maximising capacity of the available carriageway
space.
Assessment of Risk: The bus lanes have
been suspended for the past 7 years therefore the proposal will be
maintaining the existing arrangement but on a permanent
basis. Officers will follow the relevant
statutory requirements associated with revoking a Traffic
Regulation Order in accordance with the Road Traffic Regulation Act
1984.
The source of funding:
The Traffic Regulation Order to revoke the existing bus lane would
cost £5,000 and be funded from Bus Lane generated
income.
Legal Advice obtained: The Council, by
virtue of the Road Traffic Regulation Act 1984 can introduce and
revoke orders to manage traffic. Where Traffic Regulation Orders
are required, they should not give rise to any particular legal implications provided the works and
procedures are carried out in accordance with the relevant
statutory requirements, which would include the consideration of
any objections to a proposed Traffic Regulation Order.
