I, Councillor McCusker, Lead Member for Planning, Transport and Sustainable
Development, in exercise of the powers contained within the Council
Constitution do
hereby:
 
Authorise the making of the Traffic Regulation Order
below,
in the modified form, as set out in the
report:
 

City of Salford (East
Philip Street, East Salford)

(Prohibition of
Waiting and Limited Waiting Parking places) Order 2023
 
The Reasons are: That the
necessary action be taken under the Road Traffic Regulation Act
1984 to advertise the intention to make the Traffic Orders to
introduce ‘City of Salford (East Philip
Street)(Prohibition of Waiting and Limited Waiting Parking Places)
Order 2023’ to create safer environment for all road
users.
 
Options considered and rejected were:
The scheme was originally
consulted as a business permit scheme however, the two permits the
local authority would provide would not be enough for some of the
businesses located on East Philip Street.  The scheme for a limited waiting bay was
advertised in August 2022 to which 14 objections had been received.
The recommended amended scheme consists of double yellow lines
along one side of East Philip Street and to implement an
unrestricted parking bay on the opposite side to allow access to
the building and parking for the businesses.
 
One objector, representing
Paradise Works, made representations at the Lead Member Briefing
indicating that not all the businesses located at the studio would
require a parking permit, and those that did would not require more
than one.  It was reported that other
businesses located on East Philip Street had indicated that they
would require more than two permits.
 
It was suggested that the
introduction of an alternative scheme could be reconsidered
separately in the future if the requirements of the area could be
met by such a scheme.
 
Assessment of Risk: The
restrictions will be signed in accordance with the Traffic Signs
Manual and Traffic Sign Regulations and General Directions. (TSRGD
2016).
 
The source of funding
is: The scheme is funded from Highways Devolved Capital Budget for
East Salford in 2023-2024 financial year.
 
Legal Advice
obtained:
The Council, by virtue of the Road Traffic
Regulation Act 1984 can introduce orders to manage traffic. Where
Traffic Regulation Orders are required, they should not give rise
to any particular legal implications
provided the works and procedures are carried out in accordance
with the relevant statutory requirements, which would include the
consideration of any objections to a proposed TRO.
