Salford City Council - Record of Decision (CABINET)

I, Councillor Tracy Kelly, Statutory Deputy City Mayor, in consultation with the Cabinet and in exercise of the powers contained within the City Council constitution do hereby:

      i.        Adopt the Planning Obligations Supplementary Planning Document; and

      i.        Revoke the refreshed Planning Obligations SPD adopted by the Council in December 2019, subject to it continuing to have effect (and continuing to be subject to annual costs reviews) in relation to planning applications made before 2 April 2026, all as set out in footnote 13 of the Planning Obligations SPD which is the subject of this report.

The Reasons arethat the SPD provides additional detail to the implement policies in Salford Local Plan, which set out the city council’s approach to securing planning obligations. The updated Supplementary Planning Document (SPD) reflects the city council’s approach to securing planning obligations, which allow the impacts of new development to be managed.

An option considered and rejected was to not update / adopt the SPD. This was rejected as it would mean that there would be less clarity in relation to the city council’s current approach to securing planning obligations.

Assessment of Risk is low.

The SPD supplements policies in the adopted Salford Local Plan: Development Management Policies and Designations. Public consultation has taken place as part of the production of the SPD.

The source of funding associated with the SPD is from existing budgets.

This report and the consultation statement published alongside it set out the process by which the draft PO SPD has been prepared.  This process accords with the statutory, policy and constitutional requirements for the preparation and adoption of a SPD.

As set out in the report, the PO SPD will be a material planning consideration.  As such, it will be taken into account (where relevant) in the determination of planning applications.

The existing “refreshed Planning Obligations SPD”, adopted by the Council in December 2019 is to be revoked, pursuant to section 25 of the Planning and Compulsory Purchase Act 2004 and Regulation 15(2) of The Town and Country Planning (Local Planning) (England) Regulations 2012.  That revocation is subject to transitional provisions as set out in the second recommendation in this report, to allow the 2019 SPD to be applied (with annual costs increases, where appropriate) to planning applications submitted to the Council before 2 April 2026.

The Report is requesting approval for the adoption of the Planning Obligations (PO) Supplementary Planning Document (SPD), in alignment with the Ministry of Housing, Communities & Local Government published guidance as mentioned in section 1.2.

Within the post consultation SPD document under section 2.6, the document states development contribution towards the full range of planning obligations. The table below summaries the scale of contributions for 2026/2027 prices.

A  A bed space is defined as the number of bedrooms within a dwelling, plus one.
B  The number of non-principal bedrooms is the total number of bedrooms within a house, minus one

All costs identified are at 2026/27 financial year prices. In the absence of evidence which justifies a more substantive change, all identified costs will be increased annually in line with inflation by applying the Retail Prices Index annual percentage change. The revised cost will be published annually by the city council. The most up to date published cost at the point of an application’s determination will be used for the purpose of calculating the financial requirement.

Within the post consultation SPD document, section 13.6 to 13.24 explains about the implementation process of receiving payment, non-payment process and costs which will be met by the developer.
