Salford City Council - Record of Decision

I, Councillor Mike McCusker, Deputy City Mayor and Lead Member for Planning, Transport, Sustainable Development & Regeneration, in exercise of the powers contained within the City Council constitution, do hereby:

Authorise the permanent making of the Traffic Regulation Order & construction of road humps below, in the modified form, as set out in the report:

TRO 2461 LOWER BROUGHTON ROAD & ADJACENT STREETS, TRAFFIC CALMING SCHEME

The Reasons are: That the necessary action be taken under the Road Traffic Regulation Act 1984 to advertise the intention to make the Traffic Order to introduce City Of Salford (Lower Broughton Road And Adjacent Streets, Broughton) (No Stopping On School Entrance Markings, Prohibition Of Waiting, Restriction Of Waiting And Amendment) Order 2026 and City Of Salford (Lower Broughton Road And Adjacent Streets, Broughton) (20 Mph Speed Limit Zone) Order 2026 as permanent Traffic Orders. Implementation of these orders will improve road safety along Lower Broughton Road for the local community by promoting a low speed environment and ensuring side road junctions are kept clear from parked vehicles at all times. 

Options considered and rejected were: Officers considered modifying the extents of ‘no waiting’ parking restrictions throughout the scheme in response to requests for less parking restrictions as well as in some area’s requests for more parking restrictions from objectors to the scheme. Officers agreed to accommodate a compromise to the length of parking restrictions where appropriate to do so, and in some area’s maintained the originally proposed extents as there had been a history of serious collisions at these junctions.

Assessment of Risk: The scheme has been designed in accordance with the Traffic Signs Manual and Traffic Sign Regulations and General Directions 2016. The design of the scheme is also subject to the Road Safety Audit process. The scheme will contribute to improving the safety of all highway users.

The source of funding: The scheme is funded by the East Salford Highways Devolved Budget.

The Council can introduce orders to manage traffic and regulate vehicle speeds by virtue of the Road Traffic Regulation Act 1984. Where Traffic Regulation Orders and Speed Limit Orders are required, they should not give rise to any particular legal implications provided the works and procedures are carried out in accordance with the relevant statutory requirements, which would include the consideration of any objections to a proposed Order. The Council can also introduce road humps pursuant to sections 90A-90F of the Highways Act 1980 and the Highways (Road Humps) Regulations 1999.  Provided that the requirements of the legislation have been complied with, which includes giving notice of the proposals and considering such objections as may be made, no additional legal implications are raised.

The source of funding is: CRSTS, devolved to the East Salford Highways Capital Budget. Scheme costs will be monitored within the capital programme.
