The Reasons are:

The Cleggs Lane/ A6 Manchester Road is a site of concern due to a high number of recorded collisions and current lack of cycling facilities. The existing crossing facilities comprise narrow pedestrian refuges and footways which creates difficulties for pedestrians, particularly vulnerable user groups to navigate. The existing junction also has substandard cycle facilities. Representation regarding the junction have been received from the local MP, ward members and the public, mostly concerned with safety issues. Between August 2019 – August 2024 there have been seven reported collisions, all of which were of slight severity.

Options considered and rejected were:

Doing nothing will not solve the current or future problems with crossing/cycling provision.

Increasing the capacity of the junction while providing crossing facilities (Do Medium and Do Maximum options) increases time delays and adds cost with more works and service diversions.

The current proposal (Do Minimum) provides for appropriate crossing facilities while offering value for money.

Assessment of Risk:

Low: Similar junction improvement projects have been successfully delivered previously. There are no significant risks associated with the delivery of the project.

When commissioning contracts for the procurement of goods, services, or the execution of works, the Council must comply with the applicable procurement legislation and its own Contractual Standing Orders (CSO’s), failing which a contract may be subject to legal challenge from an aggrieved provider. The CSO’s stipulate that where a suitable framework exists, this must be used unless there is an auditable reason not to do so.

The proposed award of the contract follows a direct award through the Bolton Council 2024/28 Highways Framework Contract as detailed in the report, which itself was procured in accordance with the Public Contracts Regulations 2015 and CSO’s, which will help to ensure that the risk of challenge to the proposed awards is minimal and that any challenge, should it materialise, is extremely unlikely to be successful. The Council will need to have followed the procedure set out in the framework agreement to ensure the procurement process is compliant.

Under the CSO’s acceptance of a tender above £150,000 but less than £1,000,000 is delegated to the Procurement Board.

Comments: This is a request for approval to award a contract to Rosgal Ltd for the value of £837,521.29 to undertake the Cleggs Lane / A6 Manchester Road Junction Improvement Scheme.  Approval is also requested for Supervision and Management fees on the project at a cost of £66,642.62 and a Risk allocation with a total value of £185.000. The project will be financed by £775,000 S106 funding, S106 reference 276c, and £425,000 CRSTS grant funding to be received in 2026-27 from the DfT via GMCA.

This project has been procured as a further competition under the Bolton Council Framework for Highways which is compliant with SCC standing orders and PCR’s 2015.

There were 4 submissions for this tender of which Rosgal presented the most advantageous tender with a high quality score, lower price and high social value targets.

The scheme will support modal shift from private car to walking and cycling. The primary objective of the scheme is to make walking and cycling around the junction safer. More sustainable travel choices will help to reduce transport related emissions.
