Purpose

In 2024 Surrey County Council
agreed the
Level 2 Devolution Framework Agreement
with government, setting out a number of functions
that would be devolved from government to the County
Council.
 
Two functions within the deal
require parliamentary approval of secondary legislation to devolve
these functions to the County Council. One of these is the
devolution of the Homes England Compulsory Purchase Powers which
will enable Surrey County Council and Homes England to work
collaboratively to reduce the barriers to affordable housing
delivery, regeneration and wider housing growth. Surrey County
Council met government’s readiness criteria at the end of
2024 and the power was expected to be devolved in 2025, subject to
parliament approving the required secondary legislation conferring
the appropriate functions.
 
In preparation for this, on
March 18, Cabinet delegated authority to the Chief Executive, in
consultation with the Leader of the?Council, to consent to the
making of the necessary Regulations to devolve the Land Assembly
and Homes England Compulsory Purchase Powers and Adult Skills Fund
thereby implementing and giving effect to these aspects which
formed part of the County Deal agreed with government in March
2024.

Surrey County Council consent to the making of the Buckinghamshire
Council, Surrey County Council and Warwickshire County Council
(Housing and Regeneration Functions) Regulations 2025 by the
deadline of 27th May as set by the Ministry of Housing,
Communities and Local Government.
