Purpose

On 6 October 2023 Cabinet considered a report titled ‘Levelling Up Fund and Capital Regeneration Projects - Progressing the Projects to Planning Permission’. As part of that report, Cabinet delegated authority to the Corporate Director Place and Economy in consultation with the Portfolio Holder for Economic Growth, Regeneration and Tourism to procure appropriate resources and commission a project team to carry out the associated work including for the design briefs.
UKPN have an existing substation to the rear of the development site, with a right of way to allow them vehicular access across the site to the substation including for maintenance.
At present the right of way provides unrestricted access across the site, which requires a Deed of Variation to restrict the wayleave in response to the development proposals and planning consent for the redevelopment of the site.
The proposed variation provides UKPN with a 3m wide vehicular route and has secured their agreement.

Decision

To pay legal and surveyors fees of £904 and £500 respectively to UK Power Networks in relation to agreeing a Deed of Variation, varying the existing Deed of Grant dated 2nd April 1987 in which a right of way was granted in favour of UKPN on the Carnarvon Road Car Park site, as required to progress the Carnarvon Terrace development.

Alternative options considered

Having accurate and up to date legal agreements is important for record-keeping and future handover to the unitary authority.
