Decision

a) approves the Change Control Notices, incorporating confirmation of the detailed brief and procurement strategies, for the following Community Regeneration Partnership projects, with reference to the Project Initiation Documents approved in August 2025:-
i. _04 Ten Sunspot Solar Panels;
ii. Ten_07 Clacton Town Centre and Seafront Public Realm;
iii. Ten_08 Jaywick and Clacton Shopfront Improvements;
iv. Ten_10 Seafront Arts/Community Micro Venue;
v. Ten_11 Repurposing Martello Tower E;
vi. Ten_12 Active Wellbeing Centre Phase 1 and inclusive cycling facility.
b) authorises the Deputy Chief Executive and Corporate Director (Place and Wellbeing), in consultation with the Section 151 Officer and the Monitoring Officer, to approve a Deed of Variation to the funding agreement between Tendring District Council and Essex County Council to enable the transfer of additional funds to support the delivery of:
i. Ten_07 Clacton town centre public realm, increasing the project budget by £2.5m, from £1.3m to £3.8m, as approved by Cabinet in November 2025.

Reasons for the decision

Further to the decision of the Cabinet on 14 November 2025 (Minute 77 refers) and as an integral part of
progressing the relevant projects through to delivery.
To enable the projects to progress to delivery: the CCNs
provide a detailed formal record of changes to the
projects since the approval of the PIDs, including
developments to the detailed brief and approach for each project, with approval delegated to the Portfolio
Holder, and ensure that there is a clear record of changes to the projects ensuring proper control and
oversight of project delivery, and that the final results meet expectations.
To enact the lessons learned from past project
delivery including recommendations from the Oversight
& Scrutiny Committee: the CCNs follow project management best practice, providing enhanced governance and control of programme delivery.

Alternative options considered

Stop the projects now: this would forfeit significant
government funding and the opportunity to address important local issues. This course of action could have
reputational repercussions and lead to abortive costs from the work to date.
Not to approve the Change Control: this would prevent the implementation of the additional funding allocated
by Cabinet in November 2025 and thereby impact on the outcomes defined for the funding programme. It
would also risk the loss of a significant portion of the funding awarded to the Council by MHCLG, thereby
impacting on the opportunity to address important
local issues;
Not to take this decision now: due to the limited
timescale set out within the Memorandum of Understanding, swift development of the projects will
be necessary to address the programme risk and ensure defrayment is achieved during the funding period;
To approach the projects differently: the project updates
set out in the CCNs are the result of extensive
work by specialist consultant teams, informed by broad
ranging public and professional stakeholder consultation, and extensive consultation with the relevant Portfolio Holders and members. In each instance options have been carefully considered and
the proposed briefs represent the recommended
way forwards in response to the specific constraints,
opportunities and challenges on
each project.
