Purpose

The
report seeks approval to allocate and subsequently release
£51,872.14 of S106 planning obligation funding for the
improvements to the Hawkenbury path network now that it has been
received by Tunbridge Wells Borough Council.

Decision

RESOLVED –
 

1.     
That £51,872.14 of developer contributions,
pursuant of planning obligations relating to planning permission
16/07023/HYBRID, Land at Hawkenbury Farm (Original Agreement dated
8 May 2017) as amended by 18/03951/FULL DOV5, 19/02927/FULL DOV6
and 20/01306/FULL DOV8, be allocated to the improvements to the
Hawkenbury path network be approved.
 

2.     
To release £51,872.14 including indexation
subject to the conditions set out in the4 S106 agreement being met
in full be approved.

Reasons for the decision

To
agree to allocate and release the funds towards the improvement of
the path network through the use of developer contributions
collected for that purpose.

Alternative options considered

Do
nothing – This may result in the payment being paid back to
the developer.
