Decision
RESOLVED:
1.
That the purchase by the Council of the TN2
Community Centre referred to in this report and the appendices
(TN2) at the price set out in exempt appendix A and authorises the grant of a long lease (up to 99
years) of TN2 by the Council to a third party on terms to be agreed
be approved.
2.
That delegated authority be given to the Head of
Economic Development and Property in consultation with the Director
of Finance, Policy and Development, the Monitoring Officer and the
Cabinet Member for Finance and Property to negotiate and agree the
terms of the Council’s purchase of TN2 and the grant of the
long lease referred to in recommendation 1 above be
approved.
3.
That the Head of Mid Kent Legal Services be
authorised to negotiate and complete all necessary and ancillary
legal documentation and formalities to give effect to these
recommendations including the purchase of TN2 and the grant of the
long lease be approved.
REASON FOR DECISION: The purchase would enable the Council to properly control the
long term use of TN2 and ensure it gets brought back into proper
use.
CALL-IN AND URGENCY
In
accordance with the provisions of Overview and Scrutiny Procedure
Rule 14 in Part 4 of the Constitution, the Chairman of Overview and
Scrutiny gave prior agreement that this decision was urgent and
would not be subject to call-in as delay would seriously prejudice
the Council’s or public interest.
