Purpose
The
Council is the local housing authority for the purpose of
homelessness services under The Housing Act 1996. The legislation provides an applicant with a right
to request a review of certain homelessness decisions made by the
authority. Report is seeking approval
for the contracting out of the homelessness reviews function in
accordance with the Local Authorities (Contracting Out of
Allocations of Housing and Homelessness Functions) Order
1996.
Decision
RESOLVED –
1. That the ‘contracting
out’ of the Section 202 (The Housing Act 1996) homelessness
reviews function, in accordance with the Local Authorities
(Contracting Out of Allocation of Housing and Homelessness
Functions) Order 1996 be approved.
2. That
the Head of Housing, Health and Environment, in consultation with
the Cabinet Member for Housing and Planning be delegated the
authority to procure for an appoint a contractor to carry out the
Council’s homelessness reviews function and to agree the
final terms of and enter into legal agreement or contract be
approved.
3. That
the Head of Legal Services be delegated authority to complete all
legal formalities (including any procurement process(es) in
consultation with the Council’s Procurement Manager and to
negotiate, execute and complete all necessary agreements and deeds
to give effect to these recommendations be approved.
REASON FOR DECISION: To ensure the Council is compliant
with the Homelessness (Review Procedures etc.) Regulations
2018.
