Purpose

Notice
is hereby given that the Cabinet of Tunbridge Wells Borough Council
intends to make a key decision in respect of the following matter,
which may be made in private with less than 28 days’ notice
required by Regulations 5 and 9 of the Local Authorities (Executive
Arrangements) (Meetings and Access to Information) (England)
Regulations 2012.  Compliance is
impracticable for the reasons set out in the associated
notice.
 
Furthermore, notice is hereby given that the Chairman of
Overview and Scrutiny Committee has agreed that the making of the
decision is urgent and cannot reasonably be deferred.
 
 
To
consider the granting of a new lease on premises in Royal Victoria
Place.

Decision

RESOLVED –

 
1.  That the grant of a new lease
based on the key terms set out in the exempt appendix be
approved.
 
2.  That authority be delegated to
the Head of Economic Development and Property in consultation with
the Director of Finance, Policy and Development and the Cabinet
Member for Finance and Performance to agree the final terms of the
lease be approved.
 
3.  That authority be delegated to
the Head of Legal Services to complete all legal formalities as are
necessary and incidental to the recommendations in this report and
to negotiate, execute and complete the lease and all necessary
agreements and deeds arising from or ancillary or incidental to the
decision be approved.
 
REASON FOR DECISION: The grant of a new lease would enable the retention of the
tenant and delivery of financial income for the
Council. 
 

CALL-IN AND URGENCY
In
accordance with the provisions Of Overview and Scrutiny Procedure
Rule 14 in Part 4 of the Constitution, the Chairman of Overview and
Scrutiny gave prior agreement that this decision was urgent and
would not be subject to call-in as delay would seriously prejudice
the Council’s or the public’s interest.
