Purpose

The
release of s106 developer contributions to the Commons Conservators
(planning reference 21/03298/FULL), to be put towards mitigation
for dealing with the impacts of increased recreational pressure on
the Commons.

Decision

RESOLVED –
 
1.   
That developer contributions collected in pursuant
to the planning agreement in respect of planning permission
21/03298 Land adjacent and on 15-16 Eridge Road, Royal Tunbridge
Wells be released to the Commons Conservators be
approved. 
 
2.   
That contributions totalling £42,000.00 be
given to the Commons Conservators Projects Contribution, to be used
towards the Commons Projects be approved.  

 
3.   
That contributions totalling £8,000.00 (index
linked to £8,687.68) be given and used for the Commons
Contribution Purpose, to be put towards ‘mitigation for
dealing with impacts of increased recreational pressure’ on
the Commons, be approved.

 
4.   
That the s106 agreement defines the Commons
Conservators as ‘Tunbridge Wells and Rusthall Commons
Conservators, responsible for the strategic and administrative
management of Tunbridge Wells and Rusthall Commons asset out in the
1981 County of Kent Act’ be noted. 

Reasons for the decision

Agreeing the scheme with the Commons Conservators for mitigation
works on the common would comply with the s106 and Committee
report, be implemented and ensure mitigation for the effects of the
development.

Alternative options considered

Do
Nothing – the £8,000.00 Commons Contribution Purpose
sum would have to be repaid and consequently no mitigation would
take place on the common.
 
No
options were suggested for the £42,000.00, the Commons
Conservators Projects Contribution sum, as the Council were not
party to the agreement for this sum but have merely through the
s106 provided a mechanism for its collection and forwarding to the
Commons Conservators.
