Purpose
The Cabinet will be asked to consider a new
Civil Penalty Policy, Statement of Principles and Rogue Landlord
Framework. These documents are intended
to ensure that the powers and tools available to the council, when
working with landlords to improve standards in the private rented
sector are consistent, robust, transparent and represent fairness
for landlords and tenants.

Resolved:
That:
1.
The Civil Penalty Policy, attached as Appendix A to
Report number CAB/WS/25/022, be adopted.
2.
The Summary of starting fines for the Civil Penalty
Policy, attached as Appendix B to Report number CAB/WS/25/022, be
adopted.
3.
The Statement of Principle Smoke and Carbon Monoxide
Regulations Penalty Determination, attached as Appendix C to Report
number CAB/WS/25/022, be adopted.
4.
The Statement of Principle Minimum Energy Efficiency
Regulations Penalty Determination, attached as Appendix D to Report
number CAB/WS/25/022, be adopted.
5.
The working with private rented sector landlords
(Rogue Landlord Policy), attached as Appendix E to Report number
CAB/WS/25/022, be adopted.
6.
Updates to the policy to ensure new offences be
captured (as the Renters Rights Bill in particular progresses) and
following relevant case precedent, be made by the Portfolio Holder
for Housing under delegated authority.
