Cabinet will consider the acquisition of the Beethoven Centre.
Decision
Cabinet approved the following recommendations:
· Agree the principle of the Council acquiring the Beethoven Centre from A2 Dominion Homes Limited subject to completion of necessary due diligence and the satisfactory provision of Employee Liability Information for any staff potentially liable to transfer under the Transfer of Undertakings (Protection of Employment) Regulations 2006 as amended (TUPE).
· Delegate authority to the Executive Director of Finance and Resources to confirm satisfactory completion of the necessary due diligence and finalise the terms and conditions for the acquisition so that the Council can reasonably proceed, and to approve the entry into all legal agreements and associated documents and undertake all other necessary actions to secure the acquisition of the Beethoven Centre in accordance with budgetary constraints.
