Summary of Decision

The Cabinet Member for Growth and Planning has accepted the Examiner’s recommendations, as set out in the Examiner’s Report and has agreed that the Notting Hill East Neighbourhood Plan, as modified, proceeds to local referendum. The Cabinet Member has also agreed that the referendum area be restricted to the Notting Hill East Neighbourhood Area, and that in the event of a positive referendum result, the Director of Policy and Strategy be authorised to publish an Adoption Statement and formally ‘make’ (adopt) the plan.

Reasons for Decision

The Examiner’s recommended modifications will ensure the Notting Hill East Neighbourhood Plan is clear and effective as a framework for making planning decisions in the Notting Hill East Neighbourhood Area. The recommendations address the concerns raised by the council and several other stakeholders received during Regulation 16 consultation. They will also ensure the plan meets all legal requirements needed to progress to referendum. Accepting the examiner’s recommendations and proceeding to referendum will ensure the council fulfils its statutory responsibility under the Localism Act 2011 to assist local communities in exercising their neighbourhood planning powers effectively.
