The School Placings and Exclusions Appeals Committee of Aberdeenshire Council was scheduled to consider three placing appeals relating to Ellon Academy. The committee was also due to discuss its adherence to the Public Sector Equality Duty.
Public Sector Equality Duty
The committee was scheduled to consider and potentially adopt a resolution regarding its adherence to the Public Sector Equality Duty, as outlined in section 149 of the Equality Act 2010. This duty requires public bodies to have due regard to the need to eliminate discrimination, harassment, and victimisation, advance equality of opportunity, and foster good relations between individuals who share protected characteristics and those who do not. The protected characteristics include age, disability, gender reassignment, pregnancy and maternity, race, religion or belief, sex, and sexual orientation. The committee was also to consider the contents of any provided Integrated Impact Assessment (IIA) when reaching decisions.
Placing Appeals for Ellon Academy
The committee was scheduled to hear three placing appeals concerning Ellon Academy. These appeals, identified as E 1037, E 1038, and E 1052, were to be discussed in private session, as they involved information relating to the adoption, care, fostering, education, or supervision of particular children. The report pack indicated that these items were exempt from public disclosure under paragraph 5 of Schedule 7A of the Local Government (Scotland) Act 1973. The procedure for these appeals was outlined, detailing the presentation of cases by the Education Authority and the appellant, followed by questioning from both sides and the committee, and concluding with summations. The committee's decision in each case was to be notified in writing within 14 days of the hearing.
