New Premises Licence: Seventh Cavalry Restaurant, 171-173 Hornsey Road, London, N7 6RA

The committee was scheduled to consider an application for a new premises licence for the Seventh Cavalry Restaurant. The application sought permission for the sale of alcohol for on-site consumption from 08:00 to 23:00, Monday to Sunday. It also proposed the performance of live music, dance, and plays on Thursdays to Saturdays from 20:00 to 23:00, and on Sundays from 17:00 to 20:00. The premises would be open to the public from 08:00 to 23:00 daily.

The report pack indicated that while the Licensing Authority, Metropolitan Police, Noise, Health and Safety, Trading Standards, Public Health, Safeguarding Children, and London Fire Brigade had not submitted representations against the application, six local residents had raised objections. These objections primarily focused on concerns regarding the prevention of public nuisance, crime and disorder, and public safety. Residents expressed worries about increased noise and disturbance from patrons, the cumulative impact of additional licensed premises in the area, and potential anti-social behaviour.

The report recommended that if the committee decided to grant the application, it should be subject to conditions prepared by the Licensing Officer, consistent with the Operating Schedule, and any other conditions deemed appropriate to promote the four licensing objectives.

Premises Licence Variation: XOYO, Basement & Ground Floor, 32A-37 Cowper Street

The committee was also scheduled to discuss an application to vary the existing premises licence for XOYO. The current licence permits regulated entertainment, including plays, films, live music, recorded music, performances of dance, and the sale of alcohol for on-site consumption, with operating hours extending into the early morning on Fridays and Saturdays.

The proposed variation sought to extend the operating hours specifically on the Sunday preceding a Bank Holiday. The application requested to amend the hours for licensable activities on these Sundays from the current 10:00 to 01:00 the following morning to 10:00 to 05:00 the following morning. Additionally, it proposed extending the premises' opening hours on these Sundays from 08:00 to 01:30 the following morning to 08:00 to 05:30 the following morning. The provision of Late Night Refreshment would also be extended on these Sundays from 23:00 to 05:00 the following morning.

The report indicated that the Metropolitan Police, Noise, Health and Safety, Trading Standards, Public Health, Safeguarding Children, and London Fire Brigade had not raised objections. However, one local resident had submitted a representation, citing concerns about the prevention of public nuisance and the prevention of crime and disorder. The resident's concerns focused on ongoing disturbance from patrons congregating outside the venue late at night and into the early morning, loud music from vehicles, anti-social behaviour, litter, and the impact on residents' ability to sleep. The applicant's legal representative had invited the resident to a meeting to discuss these concerns.

The report recommended that if the committee granted the application, it should be subject to conditions prepared by the Licensing Officer, consistent with the Operating Schedule, and any other conditions deemed appropriate to promote the four licensing objectives. The report also noted that the premises are located within the Bunhill Cumulative Impact Area, and the committee would need to consider Licensing Policy 3, which creates a presumption of refusal unless the committee is satisfied that there will be no adverse cumulative impact on the licensing objectives.
