Mr Daly, representing the applicant, argued that the concern raised by a resident regarding the cumulative number of off-licences in the area was not a valid reason for refusal, as it is not the Licensing Authority's role to determine the need for alcohol sales. He stated there was no evidence to suggest the proposal would undermine the licensing objectives. Mr Daly also confirmed that all expected conditions for such a licence had been proposed and that the Responsible Authorities, who are experts in upholding licensing objectives, were content with the agreed conditions. He noted that the applicant had considerable retail experience, although this would be their first time as a Personal Licence Holder. In response to a member's query, Mr Daly clarified that as this is an off-licence, there was no need for conditions related to regulated entertainment, such as forbidding the use of speakers.

The Committee reasoned that the application was compliant with local policy and that the Responsible Authorities' lack of objection, in light of agreed conditions, reassured them that the licensing objectives would not be undermined. While acknowledging the resident's concern about the number of off-licences, the Committee considered this insufficient grounds for refusal, reiterating that each application must be assessed on its own merits. The Committee also noted the encouragement in the latest version of the s.182 guidance to promote economic growth. Consequently, the Sub-Committee was satisfied that granting the premises licence would continue to promote the licensing objectives.
