The approved hours extend until 01:30 on Thursdays, Fridays, and Saturdays, and until 23:30 on other days.

The decision was made after considering representations from a local resident who raised concerns about potential increases in crime and disorder, public nuisance, and public safety, particularly due to the premises' proximity to The Fox public house and its location within the Dalston Special Consideration Area. The resident highlighted issues of street drinking, anti-social behaviour, and noise in the vicinity.

However, the Licensing Sub-Committee was satisfied that the licensing objectives would not be undermined due to the applicant's proposed conditions and agreements with responsible authorities. Key conditions agreed upon include:

• SIA Door Supervision: A minimum of two SIA-licensed door supervisors will be employed from 21:00 until at least 30 minutes after closing on Thursdays, Fridays, and Saturdays, and on any other day the premises trades past 00:00. Additional security will be employed based on operational risk assessments.
• External Area Management: Staff and door supervisors will conduct regular checks outside the premises to prevent noise, loitering, and drinks being taken outside. Customers outside will be limited to 10 in a designated smoking area until 22:00, with no drinks permitted outside after this time. Customers will not be permitted to congregate outside, and door supervisors and staff will actively manage dispersal and ensure clear pavement space.
• Noise Control: Windows and doors will be kept closed during regulated entertainment, except for access and egress. A tamper-proof noise-limiting device will be fitted to the sound system.
• Dispersal Policy: A comprehensive dispersal policy will be implemented, with staff trained to manage customer exit and encourage quiet departure. Prominent notices will be displayed requesting customers to leave quietly and respect neighbours.
• Resident Engagement: A direct telephone number for the duty manager will be provided to local residents, and a log of complaints and actions taken will be maintained. Quarterly meetings with residents will be arranged.

The Sub-Committee noted that the applicant, Bannastrand Ltd, also operates the adjacent premises, The Fox, and has a track record of responsible management. They were satisfied that the proposed conditions, including those agreed with Environmental Health and the Police, were robust enough to address the concerns raised by the local resident. The decision also acknowledged that the granted licence hours are without prejudice to any planning permission requirements.
