The Licensing (2003 Act) Sub-Committee of Newham Council met on Monday 10 August 2026 to consider an application for a temporary street trading licence for a food truck. The committee decided to refuse the application.

Temporary Street Trading Licence Application - Silvertown Way

The committee considered an application from Mr Mirza Saeed Baig for a temporary street trading licence to operate a food truck, named Chiikoos, selling Mexican hot food. The proposed trading hours were Monday to Thursday, 9 am to 9 pm, and Saturday to Sunday, 10 am to 10 pm. The proposed location was opposite Canning Town Station, near the A13 flyover.

The application was opposed by the council's Highways & Sustainable Transport Team. Matthew Rolfe, Principal Network Engineer for Highways, explained that the objection was based on several grounds, including the illegality of driving and parking a vehicle on the footway, which is prohibited under Section 15 of the Greater London Council General Powers Act 1974 and Section 130 of the Highways Act 1980. Mr Rolfe highlighted that such activity could obstruct pedestrians, particularly those with disabilities, and could cause damage to underground utility apparatus. He also noted that there was an exclusion zone by Transport for London (TfL) under the Canning Town Flyover due to fire and explosion risks.

During the hearing, Mr Baig expressed his disappointment, stating he was unaware of the restrictions and had been given advice that he could trade in the area. He mentioned that he had invested significantly in his food truck and was in dire need of work due to having a young family to feed. He also pointed to examples of other food trucks trading on pavements in London, such as in front of Stratford Town Centre and the O2 Arena.

Councillor Simon Rush questioned Mr Baig's awareness of the pedestrianised area, noting the presence of numerous signs. Councillor Muhammad Majeed also raised concerns about the legality of the proposed activity and the potential for facilitating an illegal act.

The committee discussed the possibility of imposing conditions, but the Highways representative stated that they would object to condoning an illegal act. Mr Baig also enquired about trading at Stephenson Street, in front of a club called Fold, but was advised that this would likely require a premises licence in addition to a temporary street trading licence, especially if trading past 11 pm, and would involve significant costs.

After hearing all submissions, the Licensing Sub-Committee decided to refuse the application. The full written decision, which will include reasons for the refusal, will be sent to Mr Baig within five working days. The committee noted that there is no right of appeal for temporary street trading applications.
