The Licensing (2003 Act) Sub-Committee of Newham Council granted a new premises licence for BIMS, a fast-food restaurant and takeaway located at 156 The Grove, Stratford, E15 1NS. The licence allows for late-night refreshments to be served from Monday to Sunday, between 11:00 PM and 4:00 AM, with the premises open from 7:00 AM to 4:00 AM daily.
New Premises Licence for BIMS
The sub-committee considered an application for a new premises licence for BIMS, operated by HAT DISTRICT LTD, at 156 The Grove, Stratford, E15 1NS. The application sought permission to serve late-night refreshments from 11:00 PM to 4:00 AM every day, with the premises open from 7:00 AM to 4:00 AM.
A representation was received from a resident, Harry Rog, who objected to the proposed hours, citing concerns about noise, disturbance from customers arriving and leaving, loitering, and potential issues with cooking smells and mechanical extraction affecting residential flats above. The resident also noted that the premises are located within a Cumulative Impact Zone (CIZ) and that late-night refreshment falls within the scope of Newham's cumulative impact policy.
David Dadds, counsel for the applicant, argued that the application should be granted as there were no objections from responsible authorities such as the police, environmental health, or the licensing authority. He contended that the resident's objection, while noted, was a private objection
rather than a public nuisance
as only one individual had made a representation. Mr. Dadds also highlighted that the applicant had proposed a comprehensive set of conditions, including CCTV, an incident log, staff training, and prominent notices requesting customers to be considerate of local residents. He further argued that the Licensing Act 2003 is permissive and that the burden of proof lay with the objector to demonstrate how the licence would undermine the licensing objectives.
The sub-committee, after hearing submissions and deliberating in private, decided to grant the licence as applied for, including the proposed hours and all conditions listed in Appendix B of the reports pack1. The full written decision, including reasons, will be sent to the applicant within five working days.
