Open Council Network is an independent organisation. We report on Tower Hamlets and are not the council. About us
The Employee Appeals Sub Committee of Tower Hamlets Council was scheduled to consider employee dismissal appeals and review HR policy documents. The meeting was also scheduled to address procedural matters related to appeal hearings.
Appeal Against Employee Dismissal
The committee was scheduled to hear appeals against employee dismissals. This included two specific cases: an appellant's case and a management case. The report pack provided detailed information for both, with the management case encompassing a significant number of pages, suggesting a complex review. The appeals process was scheduled to follow a defined structure, allowing for the presentation of cases, questioning of witnesses, and concluding remarks from both the appellant and the management. The function of the appeal was to review the evidence and submissions to decide upon the fairness and reasonableness of the original decision, rather than to rehear the case. The panel was to consider whether new evidence was presented, if the decision was procedurally correct, and if any procedural irregularities prejudiced the disciplinary decision. Appeals could be considered on grounds relating to procedure, facts, or the decision itself, with the panel determining if the decision was one that a reasonable employer could make.
HR Policy Documents
The committee was also scheduled to review Human Resources (HR) policy documents. The report pack included a section dedicated to these documents, indicating a review of existing policies or the consideration of new ones.
Procedural Matters
Before delving into the substantive appeals, the Employee Appeals Sub Committee was scheduled to address several procedural items. This included the election of a chair for the meeting and the noting of any declarations of disclosable pecuniary interests1 by members. The meeting was also scheduled to note the established Appeals Hearing Structure, which outlines the process for conducting appeal hearings. A key procedural step was the recommendation to exclude the press and public from the remainder of the meeting. This was to be done under Section 100A of the Local Government Act 1972, as amended, on the grounds that the business to be considered contained information defined as exempt under Part 1 of Schedule 12A to the Act. This means the substantive discussions were expected to involve commercially, legally, or personally sensitive information.
