The Licensing Sub Committee Hearing Panel met to consider an application to vary the premises licence of a business in Withington.

Something More Productive, 9 Egerton Crescent, Manchester

Something More Productive Ltd applied to vary the premises licence for their premises at 9 Egerton Crescent, Manchester. The application was for permission to:

• extend the hours during which alcohol could be served on Friday and Saturday until 12.30am the following morning.
• change the hours during which the business could be open to the public on Friday and Saturday to 1am the following morning.
• extend the hours during which the business could use its outside area on Friday and Saturday until 12.30am the following morning.

Two representations were received in respect of the application. The council's Licensing and Out of Hours Compliance Team argued that:

"No additional conditions offered, nor greater risks associated with later opening times acknowledged, within this special policy area, with no exceptional circumstances demonstrated as to why the application should be granted. This would risk undermining the below licensing objectives:

The prevention of public nuisance – close proximity to residential properties would result in noise nuisance

The prevention of crime and disorder – arising from anti-social behaviour

Public Safety - arising from anti-social behaviour"

The council's Planning department argued that the variation could lead to:

"The prevention of public nuisance – extension of hours into the nighttime/early hours will generate additional noise disturbance

The prevention of crime and disorder – increased instances of antisocial behaviour

Public Safety - increased instances of antisocial behaviour"

They recommended that the applicant be advised to apply to vary condition 3 of planning permission 123650/FO/2019.
